Custom Gown Agreement (Review Version)

This agreement outlines the general terms under which CHAVAH LINDSAY (the Designer) provides custom gown design and construction services.

Each custom gown is created individually and involves dedicated design time, pattern development, fittings, and construction specific to the client.

This page is provided for review purposes only. A personalized agreement will be issued for signature following deposit payment.


Original Design Work

All custom gowns are original designs created exclusively for each client. The Designer does not reproduce existing garments or replicate designs created by other designers.


Timeline

Custom gown timelines vary depending on design complexity, materials, and production schedule. Typical timelines range from approximately 2 to 8 months, unless otherwise agreed in writing.

Timelines are estimates and not guarantees.


Consultations

Custom gown commissions include a design consultation of up to one hour. Additional design development, sketches, or samples may be subject to separate fees.

Consultations must be rescheduled with at least 48 hours’ notice. Late cancellations or no-shows may result in additional fees.


Deposit and Booking

A non-refundable deposit of 50 percent of the total project cost is required to secure a place in the Designer’s custom schedule and initiate work.

The deposit is non-refundable and non-transferable. It covers reserved design time, labor, and materials and must be paid before any design work, sourcing, or construction begins.

The deposit secures availability and design services and does not represent payment for a finished garment.

Only paid deposits or paid-in-full commissions are considered valid bookings.


Design Scope and Revisions

The scope of work includes custom design development, pattern creation, fittings, and construction as discussed and approved during consultation.

Once design approval is confirmed and materials are ordered, revisions are limited. Requests that alter the approved design, materials, or structure may result in additional fees and revised timelines.


Fittings

Fittings are conducted at the Designer’s studio during scheduled studio hours. The number of fittings required varies by project.

Fittings are intended for fit refinement and minor adjustments and are limited to a reasonable duration. Major design changes requested during fittings may incur additional charges.

Guest attendance may be limited at the Designer’s discretion.


Payment and Release

The remaining balance is due prior to the final fitting or release of the garment, whichever occurs first.

The garment will not be released until payment has been made in full.


Cancellation

If the client chooses to discontinue the project at any stage, the deposit remains non-refundable. Any completed work or materials exceeding the value of the deposit will be invoiced and payable upon receipt.

Cancellation includes failure to attend fittings, failure to respond to communication, or failure to meet agreed payment timelines.


Intellectual Property and Imagery

All designs, patterns, and construction methods remain the intellectual property of the Designer.

The Designer reserves the right to photograph finished garments for portfolio, publication, and promotional purposes unless otherwise agreed in writing.


Care and Responsibility

Once the garment has been released to the client, responsibility for care, handling, and any third-party alterations transfers to the client.


Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of New Brunswick, Canada, without regard to conflict of law principles.

Any disputes arising from this Agreement shall be resolved in the courts of New Brunswick, Canada.


Force Majeure

The Designer shall not be held liable for delays or inability to perform due to events beyond reasonable control, including illness, injury, supply chain disruptions, natural disasters, acts of government, or other unforeseen circumstances.

In such cases, reasonable efforts will be made to resume or adjust services where possible. Deposits remain non-refundable.
